EUCO: COMMISSION'S MANDATE TO DESIGN THE RECOVERY PLAN
The European Commission has been given on Thursday 23rd a mandate by the EU leaders to design the recovery plan for the COVID-19-related economic crisis. Even if the President of the European Council underlined an “unprecedented investment effort”, some elements still need to be clarified such as the size of the plan and the type of instruments used to deliver the funds, either loans or grants. This fund should be part of the multi-year budget for the period 2021-2027 and is additional to the €540 billion plan for countries, companies and workers which had been concluded by the Eurogroup and confirmed yesterday. Ursula von der Leyen plans to increase the EU’s own resources from 1.2% to 2% of the EU’s gross national product.
CJUE : HÉBERGEMENT DES DEMANDEURS D'ASILE
L’avocat général Pikamäe estime que l’hébergement des demandeurs d’asile qui se trouvent dans la zone de transit de Röszke, à la frontière entre la Hongrie et la Serbie, doit être qualifié de rétention. Il a rendu ses conclusions jeudi 23 avril dans les affaires jointes C-924/19 PPU et C-925/19 PPU dans lesquelles il appelle la Cour à offrir à ces demandeurs d’asile un niveau de protection plus élevé que celui garanti par la Convention européenne des droits de l’homme. De plus, selon lui, la législation hongroise qui prévoit un motif d’irrecevabilité des demandes de protection internationale lorsque la personne a transité par un « pays sûr » est contraire à la directive sur les procédures d’asile.
CJUE : DÉCLARATIONS HOMOPHOBES ET DISCRIMINATION À L'EMPLOI
La Cour de justice a jugé, jeudi 23 avril, que lorsque des déclarations homophobes sont prononcées par une personne influant de façon déterminante la politique de recrutement d’un employeur, elles constituent une discrimination en matière d’emploi et de travail. Afin d’obtenir la réparation des dommages, le droit national peut prévoir qu’une association a le droit d’agir en justice même si aucune personne lésée n’est identifiable.
LE POINT BREXIT
The negotiations on the future relationship between the UK and the EU resumed this week with a new round. Michel Barnier expressed his disappointment and concern during today’s press conference since the UK is slowing down the negotiations on very important issues and refuses at the same time to extend the transitional period. Four points were specially mentioned: the level playing field, the overall governance of the future partnership, fisheries and the future police and judicial cooperation in criminal matters. For the EU’s negotiator, it is not possible not to move forward on all topics concurrently. To be continued…
